Congress pulls US back from brink, averts default


Washington (AFP) - The United States was spared the ignominy of a disastrous debt default Wednesday when Congress passed a bill extending the nation's borrowing authority and ending a two-week government shutdown.


After weeks of tumultuous debate, the measure passed first with less than two hours to run until October 17, the date from which the Treasury had warned it might not be able to pay its bills.


The last-gasp plan will stave off the most pressing crisis by extending the US Treasury's borrowing authority until February 7.


Lawmakers also reached agreement on re-opening shuttered federal agencies, bringing hundreds of thousands of furloughed employees back to work and funding government through January 15.


Even before the acrimonious battle reached its finish with the House vote, President Barack Obama said he would sign the bill "immediately" as he sought to heal the wounds caused by the showdown.


But he also warned that Washington must stop governing by crisis.


US leaders needed to "earn back" the trust of the American people in the aftermath of the crisis, Obama said.


"We'll begin reopening our government immediately, and we can begin to lift this cloud of uncertainty and unease from our businesses and from the American people."


The administration's budget director Sylvia Burwell said "employees should expect to return to work in the morning."


With a bitterly divided Congress locked in stalemate for a month, Senate Majority Leader Harry Reid worked behind closed doors with his Republican rival Senator Mitch McConnell to craft the compromise that had eluded Washington.


"The bipartisan senate rose to the occasion and broke this deadlock," number two Senate Democrat Dick Durbin said.


The mood from many House Republicans was a begrudging acceptance of a deal many of them felt failed to address their desire to rein in outsized federal spending and roll back the president's health care law known as "Obamacare."


House Budget chairman Paul Ryan, who voted against the bill, called it a "missed opportunity."


"Today's legislation won't help us reduce our fast-growing debt," he said. "In my judgment, this isn't a breakthrough. We're just kicking the can down the road."


While the deal was welcomed on Wall Street, with the Dow Jones Industrial Average and the broader S&P 500 index up almost 1.4 percent, the signs of a close-to-humiliating, last-minute bid to avert possible global economic turmoil were plain to see.


The International Monetary Fund's managing director Christine Lagarde, who over the past week had pleaded with US lawmakers to come to their senses, praised them for taking the "necessary step" of lifting the debt ceiling.


"Looking forward, it will be essential to reduce uncertainty surrounding the conduct of fiscal policy by raising the debt limit in a more durable manner," she said.


After the agreement was unveiled, House speaker John Boehner bowed to the inevitable and admitted there were "no reasons" to vote against the bill, while maintaining that Republicans didn't like its terms.


"We fought the good fight, we did everything we could. They just kept saying no, no, no," Boehner said of lawmakers in Obama's Democratic Party.


"Our drive to stop the train wreck that is the president's health care law will continue," Boehner added, apparently seeking to placate Tea Party-backed Republicans.


The legislation would allow government to borrow beyond its current $16.7 trillion debt ceiling to meet its obligations.


It also provides full retroactive pay to those ordered off the job during the shutdown.


The US economy has faced uncharted waters during the more than two-week crisis, with the Treasury saying that from Thursday it would no longer be able to borrow more money and avert a devastating debt default.


Ratings firm Standard & Poor's said the government shutdown had already taken $24 billion out of the economy and will cut growth in the fourth quarter significantly.


House conservatives have thus far thwarted votes on the debt ceiling and on passing a budget, demanding concessions from Obama.


Democrats have refused to allow Republicans to hold those issues to "ransom" with attempts to slash spending or dismantle Obamacare.


But Wednesday's deal includes a mechanism that forces lawmakers into entering long-term budget negotiations, with recommendations due by December 13.


As a sign of good faith regarding what is bound to be a brutal budget battle, Democratic Senate Budget Committee chair Patty Murray said she would sit down for breakfast Thursday with Ryan to discuss the path forward.


US officials and lawmakers are likely to seek to soothe rattled world markets and re-iterate that the full faith and credit of the United States remains intact.


The Fitch ratings agency on Tuesday underlined the seriousness of the situation by putting the US government's AAA credit rating on a downgrade warning.


Major world powers have been left looking on in dismay, unable to do anything to protect their own economic interests, with many deeply invested in US Treasuries -- hitherto seen as a safe haven.


China and Japan, which between them hold $2.4 trillion in US Treasuries, have expressed alarm and annoyance at the bitter political partisanship that has caused the weeks-long crisis.

Divers Dredge Up A Half-Ton Chunk Of Russian Meteorite

Remember that bus-sized meteor that stunned thousands and injured hundreds across Russia when it entered the atmosphere and produced a massive shockwave?


Well what survived the incredible temperatures came crashing into Lake Chebarkul in central Russia and, today, divers dredged up a 1,255-pound chunk.


The BBC reports:




"Live footage showed a team pull out a 1.5-metre-long (five-foot-long) rock from the lake after first wrapping it in a special covering and placing it on a metal sheet while it was still underwater.


"The fragment was then pulled ashore and placed on top of a scale for weighing, an operation that quickly went wrong.


"The rock broke up into at least three large pieces as it was lifted from the ground with the help of levers and ropes.


"Then the scale itself broke, the moment it hit the 570kg (1,255lb) mark."




It may take a while for the rock to be certified as coming from space but the curator of meteorites at London's Natural History Museum tells the BBC, the rock has all the markings of a meteorite.


RIA Novosti, the official state news agency of Russia, quotes Viktor Grokhovsky, a member of the Russian Academy of Sciences' meteorite commission, which examined other fragments, as saying: "It's a typical meteorite, judging by its appearance – [I'm] 105 percent [sure]. There's no doubt about that, [it has] a thick melted crust, while dents reveal typical structures of the Chelyabinsk meteorite."

Van Halen Sues Drummer's Ex-Wife For Using Famous Last Name (Exclusive)

When famous people marry, their spouses often take on a famous last name. That benefit can even survive divorce. But can it be used as a commercial asset?



Witness a new lawsuit by ELVH Inc., which is the intellectual property holding company of the world-famous rock band Van Halen. The group was eponymously named after its family members -- guitarist Eddie Van Halen and drummer Alex Van Halen (bassist Wolfgang Van Halen, Eddie's son, came into the fold in 2006, replacing Michael Anthony).


In 1984, Alex married Kelly Carter. Twelve years later, he divorced Kelly Van Halen. Now, nearly two decades after the divorce papers were finalized, ELVH is taking Kelly Van Halen to a California federal court over her use of her name in trade. Specifically, Alex Van Halen's ex-wife has named her construction and interior design company after herself, which the plaintiff asserts is a trademark infringement.

Way back in 1891, the U.S. Supreme Court ruled, "A man's name is his own property, and he has the same right to its use and enjoyment as he has to that of any other species of property. If such use be a reasonable, honest, and fair exercise of such right, he is no more liable for the incidental damage he may do a rival in trade than he would be for injury to his neighbor's property by the smoke issuing from his chimney, or for the fall of his neighbor's house by reason of necessary excavations upon his own land."


The question here is whether senior family name users like Eddie and Alex can permanently enjoin junior family name users like Kelly from using "Van Halen" in a commercial enterprise. The outcome might depend on whether it can be shown that Kelly had intent to trade upon the goodwill or reputation of the famous band's moniker.

In the lawsuit, Kelly is said to have filed two trademark applications on "Kelly Van Halen" for products like chairs, children's blankets, bathing suits, building construction, interior design services and more.


The band is opposing the trademarks on the ground that the mark -- her real name -- is "confusingly similar to Plaintiff's VAN HALEN Marks in sound, appearance and commercial impression."


It's also asserted that goods in the apparel and fashion space "are either identical or closely related to the goods sold by Plaintiff," and that Kelly Van Halen is diluting Van Halen, passing off Van Halen and committing unfair competition for Van Halen.

Wine experts: EU vintners recover from bad harvest

BRUSSELS (AP) — The grape harvest in the European Union has picked up from the extremely bad 2012 season, wine experts said. But key regions in France are still struggling because of bad weather.


Several wine-producing regions had the worst harvest in a half-century last year, so the European vintners want to regain global market share with a more bountiful harvest. Overall EU production is estimated to swell by 15.2 percent compared with last year.


Thierry Coste, an expert with the EU farmers' union, said Wednesday that overall production will still be below the five-year average. France remained well below the 2011 levels, but Italy and Spain have enjoyed sizable increases.


"We are happy that we have broken with the negative spiral," Coste said.


The European harvest is essential to the global wine industry since the 28-nation EU accounts for about two-thirds of global production and 70 percent of exports, according to European Commission figures.


After output slumped to 148 million hectoliters in 2012 from an average of 175 million hectoliters, it's expected to be back up to around 170 million hectoliters. Coste said it will allow them to get back some market share lost to international competitors like South Africa and Chile.


Still, there was some bad news, especially in France.


"There have been some serious concerns due to weather vagaries for Bordeaux, the Loire Valley and Burgundy because the hail was much stronger and intense than usual," he said, referring to freak hailstorms in late spring that ravaged some of the finest French vineyards.


"Great areas have been strongly affected," Coste said. On top of that, he said the Merlot grape, an essential ingredient in Bordeaux reds, was having trouble flowering.


French production, which dropped from 50.2 million hectoliters in 2011 to 41.4 million last year, is expected to recover only to 44.1 million hectoliters.


Not all is bad news for France. The Champagne region, where an unusual growing season was followed by late harvesting, still has the promise of a great year, the local vintners' committee said.


And when it comes to quality, Coste is hopeful.


"This year the wines might have less maturity and less power than other years. But they will fully express the land they are on," Coste said.


The top European wines often do very well abroad. Overall, the EU vintners are specifically looking at the U.S.


"What we are realizing today is that there is this high demand in the United States and Europe can fulfill that demand," Coste said.

Minn. man gets annual weekend in jail for running over woman he couldn't see through frosty windshield

A Minnesota man will have to spend the weekend closest to Feb. 19 in jail every year for the next 10 years for running over and killing an 85-year-old woman whom he didn't see because his windshield was frosted over.

Robert John Tofstad, 21, of Minnesota City was sentenced to 60 days in jail and 400 hours of community service — plus the unusual annual incarceration — in a plea agreement reached in August but not filed until this month in Third Circuit Court in Rochester.



Police said Tofstad, then 19, was trying to drive by hanging his head out the driver's side window of his 1998 Saturn when he struck Ruth Doris Brendel on the morning of Feb. 19, 2012, as she was walking to church in Winona. Brendel died later that day.

Police said Tofstad was driving directly into the morning sun with the car's windshield and side windows frosted over. Weather records show that the low temperature that day was 14 degrees.

Tofstad told investigators that he had had a few drinks the previous night, and officers found suspected marijuana debris and four unopened beers in his car. The drinking age in Minnesota is 21.

In exchange for Tofstad's guilty plea to vehicular manslaughter, prosecutors dropped other charges of careless driving and underage DUI. As part of the agreement, Tofstad will be on probation for 10 years, during which he will have to check into jail over the weekend closest to the anniversary of Brendel's death. 

Tofstad is also barred from consuming alcohol and will be subject to random testing for the 10 years of his probation.

Red Sox lead ALCS after 1-0 win over Tigers

DETROIT (AP) — John Lackey figured there would be no margin for error.


So when Justin Verlander began overpowering the Boston lineup, Lackey did his best to match him, out for out.


"I knew I was going to have to pitch pretty good today," Lackey said. "He's having a great career, great season, great postseason. The guys came through."


Lackey edged Verlander in the latest duel of these pitching-rich playoffs, and Boston's bullpen shut down Detroit's big boppers with the game on the line to lift the Red Sox over the Tigers 1-0 Tuesday for a 2-1 advantage in the American League championship series.


Mike Napoli homered off Verlander in the seventh inning, and Detroit's best chance to rally fell short in the eighth when Miguel Cabrera and Prince Fielder struck out with runners at the corners.


"The runs are pretty stingy," Tigers manager Jim Leyland said. "This is what it's about in postseason, is good pitching."


Despite three straight gems by their starters, the Tigers suddenly trail in a best-of-seven series they initially appeared to control. Game 4 is Wednesday night at Comerica Park, with Jake Peavy scheduled to start for the Red Sox against Doug Fister.


Peavy set the tone Tuesday during a pregame news conference, when he sounded miffed that so much of the attention was focused on Verlander before Game 3.


"It's been funny for me to watch all the coverage of the game coming in," Peavy said. "Almost like we didn't have a starter going today. Our starter is pretty good, too."


So the Tigers aren't the only team in this ALCS with good starting pitching. That was evident after Lackey allowed four hits in 6 2-3 innings, striking out eight without a walk in a game that was delayed 17 minutes in the second inning because lights on the stadium towers went out.


It was the second 1-0 game in this matchup between the highest-scoring teams in the majors. Dominant pitching has been a running theme throughout these playoffs, which have included four 1-0 scores and seven shutouts.


The Red Sox are now two wins from an American League pennant after overcoming each of Detroit's biggest stars. Max Scherzer started Game 2 for the Tigers and was terrific, but Boston rallied from a five-run deficit against the Detroit bullpen to even the series.


Then on Tuesday, Boston came away with a win in Detroit against Verlander, and when Cabrera and Fielder came up in the eighth, the Red Sox held on.


Cabrera, who failed to reach base for the first time in 32 postseason games for the Tigers, never looked comfortable against Junichi Tazawa, swinging and missing at the first two offerings and eventually chasing an outside pitch for strike three.


"To me, I (got) myself out. I was swinging at a lot of balls out of the strike zone," said Cabrera, who has been banged up for a couple of months but homered in Game 2. "When you swing at balls, you're not able to have success."


Fielder looked even more overmatched against Koji Uehara, striking out on three pitches.


Uehara also worked the ninth for a save, ensuring that Lackey's fine performance wouldn't go to waste.


Lackey pitched poorly his first two seasons in Boston after signing an $82.5 million, five-year contract in December 2009. Then he missed all of 2012 following elbow ligament-replacement surgery.


He's been better this season, and he kept the defending AL champions off balance Tuesday by effectively changing speeds.


Napoli's first at-bat in the majors was against Verlander on May 4, 2006, at Comerica Park. He homered then, too.


"He's tough. He was on his game tonight. He was keeping all of us off balance," said Napoli, who rubbed his bat on teammate Jonny Gomes' beard before going up to the plate. "I got to a 3-2 count and put a good swing on a pitch, was able to drive it."


Detroit's three starters in the ALCS — Verlander, Scherzer and Anibal Sanchez — have combined to allow two runs and six hits with 35 strikeouts in 21 innings. Still, the Tigers have fallen behind because their bullpen blew a four-run lead late in Game 2 and the offense came up empty at home on Tuesday.


Detroit stranded runners on first and third in the first, then wasted Jhonny Peralta's leadoff double in the fifth. Peralta reached third with one out, but an overanxious Omar Infante struck out and Andy Dirks grounded out.


Napoli's homer was the first run allowed by Verlander since Sept. 18 — he pitched six scoreless innings in each of his last two starts in the regular season before blanking the opposition for 21 innings in the playoffs.


"We won a game with four hits tonight. It says a lot about this team," Gomes said.


NOTES: DTE Energy said the lighting outage was because of a cable failure in the area near the stadium. ... The last time there were four 1-0 games in one postseason was 1991, according to STATS. There were three in the NLCS and another when Minnesota beat Atlanta in Game 7 of the World Series.

The ratio is definitely low, but the startup already has some high-ranked clients, such as Amazon, Publicis and Orangina Schweppes. This new version is really what it should have been from the get-go. It looks better and it works better.
