Appeals order on gay marriages may be reversed in California

California gay marriage opponents have acted to re-impose a ban on gay marriage.

Gay weddings, which resumed across California on the weekend, may once again have to be called off.

On Friday, in a historic ruling for gay marriage, a federal appeals court in San Francisco lifted a ban that had been in place since 2008.

On Saturday, opponents of same-sex marriage in California filed an emergency petition to the US Supreme Court to try to halt any further gay weddings in the state.

Opponents have said the appeals court should have, by law, allowed them more time to appeal before the lifting of the ban.

A group called Alliance Defending Freedom has said the Supreme Court should now overrule the order by the appeals court because, by law, it had 25 days to challenge the original Supreme Court ruling.

The gay marriage ban, known as Proposition 8, was approved by voters in 2008, months after California's Supreme court decided such unions were legal.

Last Wednesday the Supreme Court ruled that a private party, such as Alliance Defending Freedom, would have to demonstrate it would suffer injury if same-sex marriages were allowed.

Gandolfini: A big man and everyman is eulogized

NEW YORK (AP) ? The funeral of James Gandolfini took place in one of the largest churches in the world and didn't stint on ceremony.

Still, the estimated 1,500 mourners who gathered Thursday in New York's Cathedral Church of Saint John the Divine seemed part of an intimate affair. They came to pay their respects to a plain but complex man whose sudden death eight days before had left all of them feeling a loss.

During the service, Gandolfini was remembered by the creator of "The Sopranos" as an actor who had brought a key element to mob boss Tony Soprano: Tony's inner child-like quality.

For a man who, in so many ways, was an unrepentant brute, that underlying purity was what gave viewers permission to love him.

"You brought ALL of that to it," said David Chase in remarks he delivered as if an open letter to his fallen friend and "Sopranos" star.

Even though Gandolfini was indisputably a formidable man both on and off the screen, Chase also saw him as a boy ? "sad, amazed, confused and loving," he summed up, addressing his subject: "You could see it in your eyes. And that's why you are a great actor."

Susan Aston, who for decades was Gandolfini's dialogue coach and collaborator, spoke of how he wrestled to find truth in his performances.

"He worked hard," she said. "He was disciplined. He studied his roles and did his homework." But then, when the cameras rolled, his performance took over and, "through an act of faith, he allowed himself to go to an uncharted place. ... He remained vulnerable, and kept his heart open in his life and in his work."

The 51-year-old actor died of a heart attack last week while vacationing with his 13-year-old son in Italy. It was cruel end to a holiday meant to be part of a summer that Gandolfini was devoting to his family ? including his son and his 9-month-old daughter ? by even turning down a movie role, according to Aston, citing what she said was her final conversation with him.

Aston said he told her "I don't want to lose any of the time I have with Michael and Lily this summer."

The actor's widow, Deborah Lin Gandolfini, also spoke at the ceremony, as did longtime friend Thomas Richardson, who affectionately described Gandolfini as a man "who hugged too tight and held too long." But now facing a world without hugs from Gandolfini, Richardson invited the congregation to stand and share hugs with their neighbors.

"It is in hugging that we are hugged," he declared.

A private family wake was held for the actor Wednesday in New Jersey.

Broadway theaters paid tribute by dimming their lights briefly Wednesday night. Gandolfini was nominated for a Tony Award in 2009 as an actor in "God of Carnage."

For Thursday's service, celebrities and fellow actors helped make up the capacity audience.

Those from "The Sopranos" included Edie Falco, Joe Pantoliano, Dominic Chianese, Steve Schirripa, Aida Turturro, Vincent Curatola, Tony Sirico, Lorraine Bracco, Steve Buscemi and Michael Imperioli.

Others from the entertainment community included Julianna Margulies, Alec Baldwin, Chris Noth, Marcia Gay Harden, Dick Cavett and Steve Carell.

NBC News' Brian Williams was in attendance. So was New Jersey Gov. Chris Christie.

So was Saul Stein, 60, a resident of Harlem.

"I came to pay my respects today because he's a character I identify with, a family man," Stein said as he waited in line outside the church.

New Jersey accents were easy to hear among those hoping for a chance to get in. A few people spoke in Italian.

Of course, both New Jersey and Italian-Americans played a big part of "The Sopranos," which originally ran on HBO from 1999 to 2007.

Chase recalled a hot Jersey day early in the show's production that bonded him with Gandolfini ? with whom he shared Italian-American working-class roots ? for all times.

Waiting to shoot the next scene, Gandolfini was seated in an aluminum lawn chair with his slacks rolled up, black socks and black shoes exposed, and a damp cloth on his head in an effort to find some relief from the heat.

"I hadn't seen that done since my father used to do it, and my Italian uncle, and my grandfather," said Chase. "They were laborers in the hot sun of New Jersey."

"I was filled with love," Chase said, struggling to keep his composure, as he described the sight of Gandolfini in the broiling sun.

"I always felt we are brothers," he said, "based on that day."

Bullock, McCarthy challenge male buddy comedies in 'The Heat'

LOS ANGELES (Reuters) - Actresses Sandra Bullock and Melissa McCarthy are mounting a challenge to this summer's male-dominated comedies with their buddy cop comedy "The Heat" opening at movie theaters on Friday.

The R-rated comedic offerings at the summer box office have so far included three guys heading to Las Vegas to hunt down a gangster in "The Hangover 3," two middle-aged men interning at Google in "The Internship" and a group of male celebrities preparing for the apocalypse in "This is the End."

"The Heat," by "Bridesmaids" director Paul Feig brings together an unlikely duo, pairing an uptight FBI agent (Bullock) with a loud and aggressive Boston cop (McCarthy) to bring down a drug lord.

Amid shenanigans that include stake-outs, family drama, a drunken night and explosions, the pair learns how to work together and a friendship develops.

Buddy cop comedies have long been a Hollywood staple, from franchise films like "Beverly Hills Cop," "Lethal Weapon," "Bad Boys" and "Rush Hour" to more recent films like "The Other Guys" and last year's "21 Jump Street" remake. But they have featured male leads.

Starring two women in such a film required some changes, Feig told Reuters.

The 50-year-old director, who has helped usher in a new wave of female-led R-rated comedies, said he wanted the characters to deal with issues that professional women would face on the job, while also showing women who enjoy being in the work force.

"We wanted to say, 'If you love your job, that's what you should be doing and maybe you might need a friend in a similar situation to be your confidante,'" he said.

Feig's 2011 film "Bridesmaids," about a bride and her friends who suffer a series of unfortunate events ahead of the wedding, was nominated for two Oscars including best supporting actress for McCarthy and made $288 million worldwide.

'THE QUEST' FOR WOMEN IN COMEDY

McCarthy, 42, saw her star rise after the success of "Bridesmaids." She followed the film up with February's "The Identity Thief," which grossed $174 million largely on the strength of her persona, and a supporting role in "The Hangover 3," where she held her own opposite the film's male-led cast.

Bullock, 48, had been mostly absent from film since winning the Best Actress Oscar for 2009's "The Blind Side," focusing instead on being a single mother to her adopted son Louis.

"The Heat," produced by News Corp's 20th Century Fox studio, marks a return to comedy for her, drawing parallels to the quirky neurotic characters she has played in 2000's "Miss Congeniality" and 2009's "The Proposal."

Feig initially was drawn to the Kate Dippold-written script for "The Heat" in part because he felt comedy films in the last few decades have been mostly male-dominated, with women depicted as the ones who ruin the good time.

"The guys are having fun, or they're out saving the world and the woman is saying, 'You need to be home with the family,'" said Feig.

"Either they are killjoys or completely unaware of the importance of what their husbands are doing - neither one of which seems fair to the women."

Feig said he felt some of his favorite female comedians are not being given a chance to shine, citing Sarah Silverman's mean girlfriend character in 2003's "School of Rock" and Rachel Harris' shrewish girlfriend portrayal in 2009's "The Hangover."

"These are movies I love, but at the same time you go, 'Well that's a waste of a hilarious person," said Feig. "I just feel like, 'God, let's right the wrongs.'"

Going forward, Feig said his next project will be a female "James Bond" comedy in the vein of "The Heat," but he stressed he doesn't want to be the only go-to guy for women in film.

"The fact that 'The Heat' is the only studio film coming out this summer that has women in lead roles is almost a backslide," said Feig. "More people have to join me in the quest."

The last time we wrote about Windows 8.1, we had lots to talk about, but very little to share in the way of hands-on impressions. You see, though Microsoft unveiled loads of new features, apps and UI tweaks, it only released a handful of screenshots -- and nobody outside the company was permitted to actually use the new software. Today, though, the OS update is available for anyone to download for free; in fact, because we're oh-so special, we've playing around with it for about 15 hours already. So while that's not enough time to put together a comprehensive review, we feel qualified to offer a few early thoughts. If you're curious, you can meet us after the break for impressions on everything from the new panorama capture feature to Xbox Radio. And yes, we brought screenshots this time. Lots of 'em.

Flawless pearls are among the most symmetrical spheres with biological origins. But how do they get so round? Turns out they turn.

Pearls form when mollusks such as oysters create so-called pearl sacs around intrusive pieces of grit. The sac coats the irritant with layers of smooth nacre, also known as mother-of-pearl. The growing pearl rotates itself, which allows the nacre to deposit evenly over its surface.

By examining pearls under a fluorescence and a scanning electron microscope, researchers discovered that the surface actually has a saw-tooth texture. As the mollusk moves, the pearl is jostled to the next tiny tooth. The work is published in the journal Langmuir. [Julyan H. E. Cartwright, Antonio G. A pearl's motion influences its nacre coverage, and thus its final shape. Depending on its surface pattern, it might turn in a single direction to create a drop or ring, or rotate more freely to form a sphere. If a defect prevents this motion, the final product will be shapeless. The resulting asymmetrical pearl is doomed to be booed. Roundly.

As quickly as 3D printers have taken off, they haven't had true OS-level support. Microsoft is fixing that with Windows 8.1: a built-in API will let developers weave 3D printing into their own apps. While the experience will be slightly more complicated than firing up an old-fashioned inkjet, it should include familiar-looking printing dialogs and persistent settings. The only real challenge will be picking up a 3D printer in the first place -- but that's getting easier by the day.

Myanmar Bans Time Magazine For Story About Buddhist Monk Wirathu

YANGON, Myanmar (AP) ? Myanmar's government has banned this week's issue of Time magazine because of a cover story about a Buddhist monk accused of fueling recent religious violence in the country.

State television announced Tuesday that the decision was made "in order to prevent the recurrence of racial and religious riots."

The magazine's cover carries a photo of a Buddhist monk, Wirathu, with the words "The Face of Buddhist Terror." Wirathu is a leader of a radical movement of monks that preaches that the country's small Muslim minority threatens racial purity and national security. He has called for restrictions on marriages between Buddhists and Muslims, and for boycotts of Muslim-owned businesses.

Nearly 250 people have died and tens of thousands, mostly Muslims, have fled their homes in religious violence in the past year. Buddhist mobs have marched through villages burning houses and mosques and brandishing machetes and clubs.

A special committee led by the home minister to deal with the recent violence said the Time article could damage government efforts to build trust among people of different religions, state television said.

The article quotes Wirathu as saying, "Now is the time to rise up, to make your blood boil." Nevertheless, Witharu insists he's a man of peace.

The article has drawn anger from Buddhists. On Sunday, the President's Office issued a statement denouncing the story and saying it damages the image of Buddhism.

The recent violence has threatened to undermine political and economic reforms undertaken by President Thein Sein, who came to power in 2011 after almost five decades of repressive military rule.

New freedoms of speech under Thein Sein have made it easier to disseminate radical views, while exposing deep-seeded racism felt by much of the population toward Muslims and other minorities.

G20 task force to study Libor reform

BASEL, Switzerland/LONDON (Reuters) - The Financial Stability Board, which sets rules for global banks, will set up a task force to look at reform of Libor after a scandal in which three banks were fined for rigging the global interest rate benchmark.

FSB Chairman Mark Carney said the steering group will report back next year on whether the benchmark should be changed and over what period, based on new international standards expected from the IOSCO group of securities regulators next month.

"What has to be taken into account is the robustness of the standard," Carney told a news conference after a FSB meeting. "We have to recognize that even some transactions benchmarks could be manipulated, it depends on depth of the market."

The steering group will be co-chaired by Martin Wheatley, chief executive of the UK's Financial Conduct Authority, and Jeremy Stein, governor of the U.S. Federal Reserve Board.

The group would also be considering ease of transition and transition costs and noted there were considerable efforts already underway to improve the London Interbank Offered Rate (LIBOR), used to help price products worth over $300 trillion.

An affiliated market participants group will review options for robust reference rates.

The FSB is tasked by the Group of 20 leading economies to coordinate regulation after the financial crisis and Carney said some parts of the financial system have not been fully repaired.

Global markets have fallen in recent days after Federal Reserve Chairman Ben Bernanke said last week the central bank expected to reduce its bond-buying later this year and halt the stimulus program altogether by mid-2014.

"What we have been urging supervisors to do... is managing their risk positions, looking at stress scenarios when there is material increase in volatility ... because eventually across all major jurisdictions the objective is to move away from exceptional emergency accommodation," Carney said.

The FSB, which met on Monday, discussed liquidity developments in all major global markets, including China where there are fears of a credit crunch. China's central bank said on Tuesday it would guide market rates to reasonable levels and manage liquidity in a flexible way.

"I would say the authorities have the situation well in hand," Carney said of China.

INSURER SUPPLEMENT

The FSB has already required 30 or so of the world's top banks to hold extra capital from 2016 to ensure taxpayers won't have to rescue lenders again in any future crisis.

Carney said the board is now finalizing which insurers will be deemed globally systemic (GSIs) and will name them in July.

Carney said those named will have to hold a capital "supplement" above a certain backstop level.

"It is possible that an existing insurer has capital above that supplement level so there is no additional capital requirement for that insurer but that calibration work remains to be done," Carney said.

Regulators will develop the backstop capital requirements to apply to all group activities, including non-insurance subsidiaries, by the G20 summit in 2014.

Carney also set a September deadline - date of the next G20 summit in Russia - for global derivatives regulators to resolve disputes over new cross border rules to make the sector safer.

Billy Ray Cyrus' heart might be achy breaky again. The country star's wife, Tish, mother of singer Miley, filed for divorce Thursday after 19 years of marriage.

"This is a personal matter and we are doing what is in the best interest of our family," the couple said in a statement. "We ask that you respect our privacy at this time."

After the news was announced, Tish Cyrus retweeted a tweet from Christian singer Tammy Trent that read, "God never promises the absence of storms. He just promises to walk with us through them!"

Back in 2010, it was Billy Ray who filed for divorce, but the couple later reconciled. "I want to put my family back together," he said at the time on "The View."

Rumors at the time forced rocker Bret Michaels to appear on "Fox & Friends" to deny a romantic relationship with Tish Cyrus.

Tish and Billy Ray wed in 1993, the year after Miley was born. They have two other children together and both have adult children from previous relationships.

Accused Bank Robber Seeks Exculpatory Evidence From NSA Trove

Via Kevin Drum comes a story of something that was pretty much bound to happen in the wake of disclosures that the National Security Agency has been trolling and collecting the "telephony metadata" of American citizens for years. The lawyer for a man named Terrance Brown, the alleged ringleader of a Brinks job plot, is asking the NSA to provide Brown's phone records for the purposes of his defense. It feels like what happens at the nexus of a lawyer grasping at straws and current events providing him with a suddenly advantageous soapbox. It's also kind of hilarious. Here's the Los Angeles Times' Matt Pearce:

Since the end of May, Terrance Brown has been on trial on suspicion of masterminding a Brinks armored-truck robbery in Florida that left a man dead in October 2010.

About a week into the trial, the Guardian newspaper published a top-secret order showing the U.S. government forced wireless provider Verizon to hand over phone records and metadata on millions of customers daily. Official acknowledgment of a broader program shortly followed.

That's when Brown's attorney, cognizant of the fact that phone data was being deployed to make the case against his client, had himself an idea:

Investigators weren't able to find all of the relevant data for Brown's phones, because his carrier apparently didn't keep records covering the entire span of the crimes.

On Sunday, after federal officials acknowledged the NSA trove, Brown's attorney, Marshall Dore Louis, filed a midtrial motion asking the NSA to turn over Brown's phone records.

"The records are material and favorable to Mr. Brown's defense," Louis wrote, adding that the request was "not intended as a general fishing expedition."

So now, the Justice Department has to get involved, and respond to this request. Pearce gets George Washington University law professor Jonathan Turley, giving great quip: "This falls into the category of 'you have to be careful of what you ask for ... The government asked for complete storage of data for all citizens, and they got it. Now they're in possession of a unique resource of information."

Turley reckons "that the government is going to be very aggressive in snuffing out this request." Still, there could be some fun days ahead. As Drum observes: "[I]t would certainly be an intriguing case for the Supreme Court to decide, wouldn't it?"

Gaza suffers drop in foreign aid over Syrian war

GAZA CITY, Gaza Strip (AP) ? A refugee from Syria recently opened a bakery here, drawing long lines of customers eager to taste meat and cheese pastries with the special flavors of Damascus ? a rare bright spot in the long shadow that the Syrian civil war is casting over the Gaza Strip.

The conflict in Syria, some 300 kilometers (190 miles) away, is increasingly hurting Hamas-ruled Gaza financially, according to several officials in the Islamic militant group and in Islamic charities.

They say Iran, an ally of Syrian President Bashar Assad and a former major financial backer of Hamas, has reduced monthly cash transfers because Hamas refuses to side with the Syrian regime.

Islamic charities abroad that used to donate heavily to Gaza have been redirecting some of their aid to Syria, forcing local charities to scale back programs, aid officials said.

"All of Gaza is suffering from this," said Noha Zaki of Gaza City's Amal orphanage, home to 100 children. Zaki said donations to her charity are down by 50 percent.

In a further costly twist, more than 1,500 people fleeing the fighting in Syria, most with family ties to Gaza, have arrived in the coastal territory since last year, with hundreds more en route.

Bassel Shunar, co-owner of the new bakery ? "Damashki" or "The Guy From Damascus" ? had a soft landing. But aid officials say they have trouble finding jobs and homes for other newcomers in crowded, impoverished Gaza.

The Hamas finance minister, Ziad Zaza, acknowledged government money problems but blamed long-running Israeli restrictions at Gaza's borders. He denied his government receives money from Iran and claimed donations from abroad are still in the normal range of $5 million to $12 million a month.

Since its founding in 1987, Hamas has operated an aboveground political wing and a secret military wing. The Sunni Muslim movement, viewed as a terrorist group by the West, is secretive about its finances. It has released only partial information about the spending of the Gaza government it formed after overrunning the territory in 2007.

After the popular uprising against Assad erupted in March 2011, Hamas quickly felt the reverberations.

Hamas leaders in exile, including chief Khaled Mashaal, were based in Damascus then, but became increasingly uncomfortable with Assad's crackdown on Syria's majority Sunnis. Assad and key members of his regime are Alawites, or followers of an offshoot of Shiite Islam.

Assad, a longtime Hamas patron, demanded that the group show support for his regime. Instead, Mashaal and others left Damascus in early 2012. Mashaal moved to Qatar, part of the Saudi-led Gulf Arab bloc that opposes efforts by Shiite Iran to expand its influence.

Iran wasn't happy. But it didn't cut ties with Hamas, which is a key to Iran's regional ambitions, including setting up armed bridgeheads on Israel's borders.

As recently as November, after a bout of Israel-Gaza fighting, Mashaal thanked Iran for its support. Hamas hard-liner Mahmoud Zahar at that time challenged Gulf states to "compete with Iran in giving us weapons and money."

Iran has reduced Gaza funding in recent months, according to an Arab diplomat and three senior Hamas figures, who spoke on condition of anonymity because they were not authorized to brief reporters on the issue.

Their estimates of Iranian cash transfers before the cutbacks ranged from $120 million to $370 million a year.

A Hamas member who provided the lower estimate said Iran has scaled back payments by 60 percent. The Arab diplomat said Iran still finances the Hamas military wing, but also increased funding for Islamic Jihad, a smaller group that occasionally fires rockets from Gaza, challenging Hamas' informal truce with Israel.

Zaza, the Gaza finance minister, blamed current money woes on Israel's border restrictions, which were at their tightest after the 2007 Hamas takeover of the territory, but have eased in recent years.

Zaza said spending cuts began two years ago, affecting every ministry, but did not explain why it became necessary at that time since the Israeli border blockade was in place well before then.

As part of the belt-tightening, ministries were ordered to slash operating costs by 50 percent, including cutting back on stationery, travel and gas allowances.

Hamas is still able to cover the government payroll ? 41,000 civil servants and members of the security forces and 10,800 participants in a job-creation program.

The wage bill alone is $37 million a month, in addition to $4 million in other operating costs, post-cutbacks, compared with local monthly revenues of $18 million, according to Zaza. He did not say how the deficit is being covered.

Meanwhile, Osama Kurd, coordinator of some 200 Islamic charities in Gaza, said there has been a sharp drop in donations from abroad because more aid is going to Syria. He would not give the annual amount in donations.

Abdel Qader al-Attar of the Islamic Charity, the largest such group in Gaza, said foreign support has decreased by more than 30 percent.

"The Syria crisis has affected aid to the poor in Gaza," he said. "Our donors in the Gulf and in Europe told me clearly they have shifted part of their aid to Syria."

The charity has reduced financial aid to thousands of students by 40 percent, cut back on food distributions to 14,000 families and lowered payments for needy patients, al-Attar said.

The shift is apparent in the Arab world. In Kuwait, charities operate trailers near supermarkets. Billboards on the trailers used to appeal for help for Gaza but now have switched to Syria.

Nael Assad of the Kuwait-based International Islamic Charity Organization said donations to Gaza have dropped, and that most of the aid goes to Syria. He did not provide figures. The main Turkish charity, IHH, said it hasn't cut back in Gaza.

Gaza's money troubles come at a time when the main U.N. agency aiding Palestinian refugees and their descendants ? a majority of Gaza's 1.7 million people ? is also scaling back some services due to a long-running budget crisis.

The Palestinian refugee problem goes back to the 1948 war over Israel's creation, during which hundreds of thousands of Palestinians fled or were driven out. Those refugees and their descendants now number about 5 million people scattered across the Middle East, including in Syria, where some are displaced again.

More than 1.6 million Syrians have fled to neighboring countries since 2011.

Among those, more than 1,500 ? most of them of Palestinian origin, but also a few dozen Syrians ? have sought refuge in Gaza, and hundreds more are en route, said Mazin Abu Zaid of the Palestine Liberation Organization.

Shunar, the bakery owner, arrived 2 1/2 months ago with his Gaza-born wife. Shunar grew up in the Yarmouk refugee camp near Damascus and said he earned a good living with a home-decorating business.

The 45-year-old said he would like to return to Syria, despite the thriving business he recently opened in Gaza, using most of his savings.

Hassan Awad, 43, an English teacher from the Syrian coastal town of Latakia, also dreams of going back to Syria. Awad, his wife and three children were taken in by his Gaza relatives six months ago, and he has found temporary work as a translator.

It's hard to get used to cramped quarters in Gaza City's Sheik Radwan neighborhood, he said. But given the violence, a return to his hometown is unlikely.

"It's very crowded in Gaza, but what shall we do?" he said.

Apple's WWDC 2013 keynote to be streamed live on Apple TV (update: now on Apple's Events page, too)

Apple's WWDC 2013 keynote livestream makes appearance on Apple TV

A new channel has just popped up on Apple TV for its WWDC 2013 Keynote, meaning that a livestream of the big event will be available for viewing there -- just like last time. The HD stream will kick off at 10AM Pacific time, and there's a chance you'll see it on Apple's Events page as well, if history repeats itself. You can also catch past extravaganzas at either spot (see the More Coverage link), and naturally, we'll have a full liveblog of our own -- so there's no chance you'll miss any of the fun.

Update: The WWDC 2013 Keynote livestream link has now arrived to Apple's Events page as well (at the source, below), though you'll need to be on Safari 4 with OS X 10.6 or Safari on iOS 4.2 at a minimum to watch it.

Kelly Ayotte To Back Immigration Bill In Senate

WASHINGTON (AP) -- Republican Sen. Kelly Ayotte on Sunday said she would support the bipartisan immigration overhaul under debate in the Senate and criticized "the broken immigration system we have now" as "unworthy of a great nation."

In a television interview and in a longer statement on her website, the New Hampshire senator became one of the first Republicans who didn't write the bill to line up behind the proposal that would offer a pathway to citizenship for the estimated 11 million immigrants living in the country illegally. Ayotte's support helps the bill's advocates move closer to the 60 votes needed to avoid a filibuster.

"The status quo isn't working. It's de facto amnesty. We need immigration reform that serves the best interests of our country," Ayotte wrote on her website.

A bipartisan group of eight senators -- four Republicans and four Democrats -- drafted the bill.

The Senate Judiciary Committee approved the measure last month with support from two of the Republican authors, along with Sen. Orrin Hatch. However, the Utah Republican says he will vote for the measure in the full Senate only if it includes higher penalties and delayed Social Security benefits for immigrants living illegally in the country.

Separately, Sen. Marco Rubio, R-Fla., said he will vote for the bill he helped write only with stronger border security than the bill already includes.

As drafted, the legislation also creates a low-skilled guest-worker program, expands the number of visas available for high-tech workers and de-emphasizes family ties in the system for legal immigration that has been in place for decades.

The legislation creates a 13-year route to citizenship for an estimated 11 million immigrants currently living in the United States illegally.

The bill is a "tough but fair way" for the estimated 11 million to come "out of the shadows" and "earn citizenship -- go to the back of the line, pay taxes, pass a criminal background check, learn English," Ayotte told CBS' "Face the Nation."

It also sets border security goals that the government must meet before immigrants living in the U.S. illegally are granted any change in status.

"As a nation of immigrants, we must remember that we're all descended from people who came here from somewhere else in search of a better life," she said.

"But the broken immigration system we have now is unworthy of a great nation," she added. "It's time for Washington to tackle this problem head on."

Despite support from the White House, the AFL-CIO labor unions and the pro-business Chamber of Commerce, the bill's passage is by no means assured. Sixty votes are usually required to end Senate debate and consider adoption. There are currently 54 senators, including two independents, in the Democratic caucus, and 45 Republicans.

Leaders in the Democratic-led Senate want a final vote on the legislation by July 4.

The Republican-led House, meanwhile, is taking a smaller, piecemeal approach to the issue. Many of the components of the Senate bill are likely to find strong opposition there, giving House Republicans greater sway even before the Senate votes.

"What they have in the Senate has zero chance of passing in the House," said Sen. Rand Paul, R-Ky. "So, why not come to a conservative like myself and say, he's willing to work with you, why not work with me to make the bill closer to what would be acceptable in the House?"

Sen. Ron Johnson, R-Wis., said he remained hopeful a bill could be passed but said the bill would have to see changes if it stood any chance in the House.

"It doesn't do anybody any good just to pass in the Senate," Johnson said.

Immigration also has deep political implications.

In 2012, President Barack Obama won re-election with the backing of 71 percent of Hispanic voters and 73 percent of Asian voters. A thwarted immigration overhaul could send those voting blocs more solidly to Democrats' side in future elections. That has led some Republican lawmakers to support immigration reform, but the party's conservative base still opposes any legislation that would create a pathway to citizenship for immigrants living here illegally.

Malta rules out legal action against former EU Commissioner

VALLETTA (Reuters) - Malta does not have enough evidence to start criminal proceedings against former EU Health Commissioner John Dalli in a bribery case, Malta's Police Commissioner Peter Paul Zammit said on Monday.

Dalli resigned in October after OLAF, the EU's anti-fraud agency, said there was circumstantial evidence he was aware former assistant, Silvio Zammit, was seeking a bribe to arrange a meeting between him and tobacco group Swedish Match.

Swedish Match had itself told the Commission that a Maltese businessman asked it for 60 million euros ($78 million) in order to use his links to Dalli to get him to propose an end to an EU export ban on snus, a snuff that is the company's main product.

Dalli always denied the allegations and is suing the European Commission for wrongful dismissal.

Silvio Zammit, on trial in Malta, has pleaded innocent.
